In the space for the plaintiff, insert the name and address of the person filing the lawsuit. Specify whether the plaintiff is an individual doing business under a fictitious name. Sign where indicated. Also indicate if you are suing as a corporation, and have the Statement of Claim Form signed by the officer of the corporation or its attorney.

Insert the name and address of the person(s) or business you are suing in the space marked "defendant". You must have the defendant's complete name and address (do not use a post office box). If the defendant is a corporation, provide the name of an officer or registered agent of the corporation so that the notice can be served. This information is available from the Secretary of State, Corporation Filing Division, Tallahassee, FL 32304. (The corporate printout must accompany the claim prior to the pre-trial conference.  Information on corporations or fictitious names is available at www.sunbiz.org, click on Search Our Records.

Briefly state your claim, and the amount you are suing for in the spaces provided. If your claim is based on written documentation, attach it to the original Statement of Claim form.

The Statement of Claims form must be completed in its entirety and signed.  File the original Statement of Claim form with the Clerk of the Circuit Court and County Comptroller.  Provide the Clerk and Comptroller with two identical copies of any supporting documents for each defendant named.  In the event the plaintiff wants to retain a copy for their own records, a total of three identical copies would be required. Copies can be made for your convenience by the Clerk and Comptroller at a cost of $1.00 per page.

The Clerk and Comptroller will then prepare the Summons/Notice to Appear. 

Removal of Confidential Information

When filing court documents, each filer is responsible for redacting or identifying for redaction confidential information, such as social security numbers, bank account numbers, and other non-public information. Be sure your filing is in compliance with amended Judicial Rule of Administration 2.420, which is effective July 1, 2021. A Notice of Confidential Information form must be filed with documents containing confidential information.  The following video contains more information.
