Legal Representation in Family Law Cases
As in all matters involving the law, if you don't feel fully comfortable or qualified to represent yourself, you may want to consider obtaining the services of a competent attorney. If you decide to represent yourself in the specific family actions that are listed below, this office can provide you with the appropriate packet. The packets are comprised of Florida Supreme Court Approved Family Law Forms as well as additional forms provided by the 12th Judicial Circuit. The Florida Supreme Court Approved Family Law Forms have been developed for use by the Florida Supreme Court and are designed for use by everyone, but are especially helpful to individuals who wish to represent themselves (pro se) in court matters related to family law. The additional forms in the packets that are provided by the 12th Judicial Circuit are forms that are designed for specific use within the 12th Circuit. The 12th Judicial Circuit Family Division of Self Help Office provides case management services for Non Child Support Enforcement Family Division matters. Family Law Form Packets
You may visit the Clerk and Comptroller's office to purchase and pick up the appropriate family packet or you may order the forms by mail or phone. The price for the packets are shown after the description for each packet. You may also print out the form packets from the 12th Judicial Circuit website. You can access these packets by selecting the link below. A brief description of each type of packet is also provided.
Name Change
Petition for Name Change (Adult) - Used when an adult wants the court to change his or her name. This form is not to be used in connection with a divorce action. If you want a change of name because of dissolution of marriage that is not yet final, the change of name should be done as part of that case. If purchased at the Clerk and Comptroller's office, the price of the packet is $2.25
Petition for Name Change (Minor Child) - Used when parents want the court to change the name of their minor child(ren). For the purposes of this proceeding, a person under the age of 18 is a minor. This form is not to be used in connection with an adoption or paternity action. If you want a change of name for your child(ren) because of dissolution of marriage, paternity, or adoption action that is not yet final, the change of name should be done as part of that case. If purchased at the Clerk and Comptroller's office, the price of the packet is $5.25
Petition for Name Change (Family) - Used when a family wants the court to change it's name. This form is not to be used in connection with a divorce, paternity, or adoption action. If you want a change of name because of dissolution of marriage, paternity, or adoption action that is not yet final, the change of name should be done as part of that case. If purchased at the Clerk and Comptroller's office, the price of the packet is $5.55
Custody, Time-Sharing, Relocation, Paternity, Change to Child Support
Supplemental Petition to Modify Parental Responsibility, Time-Sharing and Other Relief - Used when you are asking the court to change the current Parenting Plan/time-sharing schedule. The court can change the parenting Plan/time-sharing schedule if the judge finds that there has been a substantial change in the circumstances of the parties and the change is in the child(ren)'s best interests. If purchased at the Clerk and Comptroller's office, the price of the packet is $7.95
Supplemental Petition to Modify Child Support - Used when you are asking the court to change a current court-ordered child support obligation. The court can change a child support order if the judge finds that there has been a substantial change in the circumstances of the parties and the change is in the child(ren)'s best interests. If purchased at the Clerk and Comptroller's office, the price of the packet is $7.65
Petition to Determine Paternity and Other Relief - Used by a birth mother or father to ask the court to establish paternity, a time-sharing schedule, and/or child support of a minor child or children. This means that you are trying to legally establish who is the father of the child(ren). If purchased at the Clerk and Comptroller's office, the price of the packet is $9.75
Enforce Order / Contest Judgment
Motion for Civil Contempt/Enforcement - Use to initiate a civil contempt/enforcement proceeding against a party who is not complying with a prior court order, you must file a motion with the court explaining what the party has failed to do. If purchased at the Clerk and Comptroller's office, the price of the packet is $3.15
Motion to Contest Impending Judgment - Used when Respondents want to contest a Notice of Impending Entry of Judgment for Delinquent Support Payments regarding child support or alimony in cases that DO NOT involve Child Support Enforcement. If purchased at the Clerk and Comptroller's Office, the price of the packet is $2.10
Support Not Connected to Dissolution
Petition for Support Unconnected with Dissolution of Marriage with Dependent or Minor Children - Used to ask the court to enter a support order if you and your spouse are separated, and your spouse has the ability to contribute to you and your minor child(ren), but has failed to do so. If purchased at the Clerk and Comptroller's office, the price of the packet is $8.10
Petition for Support Unconnected with Dissolution of Marriage with No Dependent or Minor Children - Used if you and your spouse are separated, but a dissolution of marriage has not been filed, and you are requesting alimony. If purchased at the Clerk and Comptroller's office, the price of the packet is $6.90
Alimony
Supplemental Petition for Modification of Alimony - Used when you are asking the court to change a current court-ordered alimony obligation. The court can change an alimony order if the judge finds that there has been a substantial change in the circumstances of the parties. If purchased at the Clerk and Comptroller's office, the price of the packet is $5.70
Stepparent Adoption
Joint Petition for Stepparent Adoption - Used when a stepparent is adopting his or her spouse's child. If purchased at the Clerk and Comptroller's Office, the price of the packet is $6.75
